按W-8Ben狀態據以採取不同預扣稅，是券商的責任。
如果您的W-8ben過期，但券商沒注意還是按外國人身分處理稅務，才是錯誤，
加簽這部分只是券商要撇清在您沒及時更新W-8BEN期間萬一有甚麼責任而已。
至於因W-8過期以致資本利得被券商預扣28% BACKUP WITHHOLDING
券商按法規做事沒有任何錯誤，退款不可能，稅金是要上繳IRS的又不是券商自己賺，
但券商有義務於翌年提供1099表格列出預扣明細，透過報稅取回預扣稅金是絕對沒問題的
